Consent Orders

If you and your ex-partner agree on the terms by which you would like to arrange custody & care for your child, then you do not actually need to file any official paperwork to do so.

However, for additional security you may wish to draft a ‘consent order’. This is a legal record of the terms you and your ex-partner have agreed upon.

You will have to apply for a court order to have your Consent Order approved, but your solicitor can help you do this.

Arrangement Orders

According to the UK Government a Child Arrangements Order can be defined as detailed below.

‘A Child Arrangements Order’ decides:

  • where your child lives
  • when your child spends time with each parent
  • when and what other types of contact take place (phone calls, for example)

Our Family Law Solicitors are able to help you through this process and ensure that the terms of your Child Arrangements Order are fair and as evenly split as possible.

Child Matters
Specific Issue Order

A Specific Issue Order could cover the following: consent to medical treatment or examination, determination of where the child is educated, approval of a change of child’s surname, settle religious issues e.g. circumcision, require child to be told of father’s identity.

This is not an exhaustive list and other issues may be cover by an Specific Issue Order. Your solicitor can help establish whether this would be a good option for you.

Extended Family

Unfortunately, during the break down of a relationship there is often more people affected than just the parents and children. Members of extended family, such as grandparents, also experience the heartbreak of losing contact in the case of a separation.

Whilst legally extended family are not considered to have the legal right to apply for a Court Order to see a child, they can apply for permission to do so.

Child Matters
Prohibited Steps Orders

If you are in a situation where you believe your ex-partner may be likely to intentionally go against your wishes with a decision relating to your child, then you may consider taking out a Prohibited Steps Order.

This will directly confront the issue you are concerned about and prohibit your ex-partner from conducting these actions. Issues often covered by a Prohibited Steps Order can include; removing the child from the country, assigning the child another name, making changes to the child’s schooling, and more.

‘Live so that when your children think of fairness, caring, and integrity, they think of you.’
