What are Nuptial Agreements?

Nuptial Agreements can be defined as a set of terms agreed by a couple regarding division of assets or finances, pre or post marriage.

Pre-Nuptial Agreements take place before marriage, and Post-Nuptial Agreements are agreed after the marriage is already complete and valid.

There are many reasons why couples choose to have Nuptial Agreements and despite common misconceptions, it is not a negative thing nor does it mean the couple is unhappy. Common reasons for choosing to have a Nuptial Agreement with your partner may include:

  • Protecting the inheritance of children from previous partners. Should you and your partner seek divorce in the future, you may wish to preserve a separate inheritance for children you may have from a previous relationship. If you do not choose to do this, money or assets you are planning on leaving to your children may be considered marital property against your wishes.
  • If you or your partner have a particularly notable wealth disparity, you may wish to protect your personal financial status by making a pre or post Nuptial Agreement so that your partner does not receive a disproportionate amount of your wealth in the event of a divorce.
  • Many couples get pre or post nuptial agreements for the simple reason of avoiding unnecessarily long and distressing battles in court over the division of assets. Divorce proceedings can be an incredibly taxing and emotional experience, so if you and your partner are willing to have open and honest conversation about the possibility of your relationship ending and what you would like to happen if it did, then you may save yourselves a lot of time and further heartache.

Idara is a newly qualified Solicitor with over 10 years’ experience in the legal field. Prior to qualifying as a Solicitor, Idara worked as a Caseworker with a varied caseload including family law cases. She has a varied caseload covering Private Family matters including Divorce, Child Arrangement Orders, Specific Issues Order, Financial Relief, Special Guardianship, Non-Molestation and Occupation Order.
